The government proposes an obligation to control the work schedule

In this post we explain what work schedule control is and what obligations companies have to implement it. We also present the problems of excessive control to the workers under the new location technologies.

 

Work schedule control was passes on the last 8 of March 2019 during the Minister Council, which observes the obligation for all companies to register their workers’ hours. The royal decree-law modifies the Statute of Workers in respect to the schedule register so that companies control their workers’ hours on a daily basis. This must include the start and end times, regardless of flexible hours.

 

It also establishes that registers must be kept for four years and they will be available to unions, workers, and Work Inspection and Social Security.

What does the law say about the control of workers’ hours?

The Government proposes that all workers, regardless of the size of the company, are compelled to check in and out, according to the labour reform draft that the Administration sent to the unions and the employers’ association. The document establishes that article 4 of the Workers’ Statute must recognize as each worker’s basic labour right the fact of “knowing the duration and distribution of their ordinary working day, as well as their schedule.”
The Government wishes to regulate the working day and impose controllers to enforce it: the compulsory register of the working day, as a means proposed by the unions to put an end to labour fraud in recruitment.

 

Companies must register their workers’ hours from the 12th of May, when the recently passed modification of the Workers’ Statute will become effective. In addition they will be compelled to keep those data for four years.

Work hours in Spain are currently regulated by the Workers’ Statute in reference to two cases:

Part-time workers: it must be registered daily and it will be added up monthly. The worker will be given a copy along with their salary sheet summing up the monthly hours, both ordinary and complementary. In this case, failing to comply with this regulation may have serious consequences for the company, as a lack of register implies that it is a full-time contract.

 

Counting extraordinary hours: extraordinary hours must be registered and workers must be informed so they can verify their correct retribution. The modification of the Workers’ Statute compels all workers to check in and out regardless of the company’s size.

“All infractions regarding the register of the work hours will be considered SERIOUS, with fines ranging between €626 and €6,250 according to the degree of the infraction.”
